By downloading Porsche advertising materials (collectively, the "Advertising"), Dealer hereby agrees that Dealer will ONLY use the Advertising, without alteration, in the specific medium (TV, radio, Internet, etc.) and market specified during the dates listed. By downloading and using the Advertising, Dealer agrees that Dealer will be solely liable for any costs or expenses related to use of the Advertising past the dates specified or in a manner inconsistent with the limitations listed. Dealer also agrees to remove any Advertising used in any medium (TV; in store; industrial; online including, but not limited to, YouTube, social media, or on a Dealer's website etc.) on the end date provided when downloading the Advertising on Dealer Marketing Platform or when the footage expires, whichever occurs first. Notwithstanding the foregoing, Dealer agrees to immediately remove any Advertising used in any medium if, PCNA, in its sole discretion, requests such removal.
Dealer hereby agrees to be responsible for any talent payments, music license fees, penalties, expenses or damages related to Dealer's usage of the Advertising in a manner inconsistent with the limitations listed and agrees to remove and destroy all Advertising upon the completion of use. If Dealer alters Advertising without PCNA's permission; uses Advertising outside of the agreed upon dates, markets or medium; or continues using Advertising after PCNA requests its removal, Dealer will be solely responsible for any fines, union penalties, and damages, including those for breach of contract for use of music and other licensed properties that relate to or arise out of such usage.
As always, Dealer is ultimately, and solely, responsible for its marketing and promotional communications. Dealer must ensure that Dealer's marketing and promotional communications are fully compliant with applicable local, state and federal law.
By downloading the material, you acknowledge that, as an authorized representative of Dealer, you have read, understand and agree to these terms.
